Employee share collected since January 2009 not deposited at EPFO yet

The Sub regional office of the Employees Provident Fund Organization on Monday filed a case of criminal breach of trust against a former Municipal Commissioner and present Commissioner of Vizianagaram for allegedly not having paid the PF amount of some of its employees since January 2009. Regional PF commissioner at the EPFO sub regional office in Visakhapatnam in a press release stated that the above offence was found out during a verification taken up by EPFO to check the compliance of various municipalities with the existing stipulations of the EPFO and the laws under Sec.7A of EPF Act.
It was found that Vizianagaram Municipality which had engaged nearly 284 contract workers, in spite of of deducting the employees share of the PF from their salaries was not depositing the same with the EPFO that tantamount to criminal breach of trust. Explaining the legal provisions for accusing the municipal commissioner, the release stated that non payment of collected PF amount is in violation of the para 32(3) and 38(1) of the EPF Act.
The PF Commissioner informed that the municipal commissioners were considered as employers and were directly responsible for looking after the payment of money to the EPFO. Further, he said the offence came under the Sections 406 and 409 of the IPC that deal with criminal breach of trust by public servants. It is learnt that enforcement officer has filed a complaint against former commissioners S Uday Bhaskar and present incumbent S Nagabhushana Rao for non payment of funds to the tune of Rs.3,98,533 and 6,93,012 respectively.
